Terms of Use

Welcome to Yapville. These terms are the agreement between you and PALMS STUDIO LLC ("we", "us") for using the Yapville apps for iPhone and Android and the web version at yapville.palmstudio.app (together, "Yapville"). We have tried to keep them short and plain. By using Yapville you agree to them, so please read them, together with our Privacy Policy, which explains how we handle your data.

Who can use Yapville

• You must be at least 13 years old.
• If you are under 18, or under the age of majority where you live, a parent or guardian should read these terms with you and agree to them for you.
• You may not use Yapville if the law where you live does not allow it.

What Yapville is

Yapville is a game for practising a language by talking. You live in a fictional town and have spoken conversations with its residents, then review what you learned.

• The characters are AI. Their words are generated in the moment by an artificial intelligence model and spoken by synthetic voices. They are fictional; any resemblance to real people is a coincidence.
• AI makes mistakes. Characters, corrections, translations, word notes and level estimates can be wrong, incomplete or unexpected. Yapville is a place to practise, not a source of facts or advice. Do not rely on it for medical, legal, financial, safety or other important decisions, or in an emergency.
• No guarantee of results. We hope you learn a lot, but we cannot promise any particular level, test score or outcome.
• An internet connection is needed for conversations. Some parts of the town may be available only at certain times of day, as part of the game.

Your account

Yapville creates an account for you so your progress can be saved and backed up. Later you may be asked to sign in with Apple or Google. Keep your device, your sign-in and any save recovery code safe: anyone who has your recovery code can open your save. Tell us at yapville@palmstudio.app if you think someone else has accessed your account. You can delete your account at any time, as described in the Privacy Policy.

Using Yapville fairly

Please be a good neighbour. You agree not to:

• use Yapville to break the law or to harm, harass or threaten anyone;
• try to make the characters produce content that is sexual, hateful, violent, dangerous or otherwise harmful, or try to get around the limits we put on the AI;
• put other people's personal data, or anything you do not have the right to share, into conversations or reports;
• copy, sell, rent or resell Yapville or its content, or use it to build a competing product or to train AI models;
• scrape, overload, attack, reverse engineer or bypass the security, usage limits or technical protections of Yapville, except where the law expressly allows it;
• use bots or automated tools to talk to the characters or to access our servers;
• pretend to be someone else, or share an account in a way that lets others get around these terms.

We may limit, suspend or close an account that breaks these rules or puts other people or the service at risk. Where it is reasonable, we will tell you why and give you a chance to respond.

Your content

What you say and write in Yapville (your conversations, names, notes and reports) remains yours. You give us a worldwide, non-exclusive, royalty-free permission to process that content only as needed to run, maintain and improve Yapville for you, as described in the Privacy Policy. This permission ends when your content is deleted, except for copies we must keep by law.

The lines the characters say to you are generated for your personal learning. You may use them for your own, non-commercial purposes.

If you send us ideas or feedback, we may use them freely without owing you anything.

Our content

Yapville, including its towns, characters, stories, pictures, sounds, software and the Yapville name and logo, belongs to PALMS STUDIO LLC or its licensors and is protected by intellectual property laws. We give you a personal, limited, non-exclusive, non-transferable, revocable licence to use Yapville on devices you own or control, for your own non-commercial learning, in line with these terms. Open-source software included in Yapville is covered by its own licences, listed in Settings › About.

Price

Yapville has no purchases today. If we introduce paid features, we will tell you the price and terms clearly before you pay, and purchases in the apps will be handled by Apple or Google under their terms.

Changes and availability

Yapville is a living game: we add and change places, characters, stories and features, and we may remove some. We try to keep Yapville available, but it may sometimes be interrupted for maintenance or reasons outside our control. We may stop offering Yapville; if we do, we will give reasonable notice in the app where we can.

Ending the agreement

You can stop using Yapville and delete your account at any time. We may end these terms or your access if you seriously or repeatedly break them, if the law requires it, or if we stop offering Yapville. The sections that by their nature should last (for example, ownership, disclaimers, limits of liability and governing law) continue after the agreement ends.

Disclaimers

We provide Yapville with care, but "as is" and "as available". To the fullest extent the law allows, we make no warranties beyond those set out in these terms, including implied warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement. Nothing in these terms limits rights you have as a consumer that cannot be limited by law.

Limits of liability

To the fullest extent the law allows, PALMS STUDIO LLC will not be liable for indirect, incidental, special, consequential or punitive damages, or for lost data, profits or opportunities, arising from your use of Yapville. Our total liability for any claim relating to Yapville is limited to the greater of the amount you paid us in the 12 months before the claim or 50 US dollars.

These limits do not apply to liability that cannot be limited or excluded by law, such as for death or personal injury caused by negligence, for fraud, or for gross negligence or intent. If you live in the European Union or the United Kingdom, we are responsible for foreseeable loss caused by our breach of these terms or our failure to use reasonable care and skill.

Apple and Google

If you downloaded Yapville from the Apple App Store or Google Play:

• These terms are between you and PALMS STUDIO LLC only, not Apple or Google. We, not Apple or Google, are responsible for Yapville and its content.
• Your licence is also limited to use on Apple- or Android-branded devices you own or control, as the store's usage rules allow.
• Apple and Google have no obligation to provide maintenance or support for Yapville.
• If Yapville fails to meet an applicable warranty, you may tell Apple, and Apple may refund the purchase price, if any. To the extent the law allows, Apple has no other warranty obligation for Yapville.
• Apple and Google are not responsible for addressing any claims by you or anyone else relating to Yapville, including product liability claims, claims that it fails to meet legal or regulatory requirements, consumer protection or privacy claims, or claims that it infringes someone's intellectual property. We are responsible for investigating and handling those.
• You confirm that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not on any U.S. Government list of prohibited or restricted parties.
• Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
• You also agree to follow the terms of the store you used and of any third-party service you use with Yapville.

Governing law and disputes

These terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-law rules. Before bringing a claim, please contact us at yapville@palmstudio.app so we can try to resolve it together. If you are a consumer living in the European Union, the United Kingdom, Turkey or another country whose law gives you the right, you also keep the protection of the mandatory laws of your country and may bring a claim in the courts where you live.

Changes to these terms

We may update these terms, for example when we add new features or when the law changes. We will update the date at the top, and if a change is significant we will tell you in the app before it takes effect. If you do not agree with the new terms, you can stop using Yapville and delete your account.

General

If any part of these terms cannot be enforced, the rest still applies. If we do not enforce a term straight away, we have not given up the right to do so later. You may not transfer these terms to someone else; we may transfer them to a company that takes over Yapville, without reducing your rights. These terms and the Privacy Policy are the whole agreement between you and us about Yapville.
